Athlete still faces jail time

Rape charge was dropped against Ghysels, but he's charged with contributing to the delinquency.

The former Springboro sports star freed from the Warren County Jail on Thursday, May 15, after authorities dropped a rape charge against him, is expected to remain free until a pre-trial hearing June 18, according to court records.

No arraignment is scheduled in Warren County Juvenile Court for David Ghysels, 20, on a misdemeanor charge of contributing to the delinquency that was filed the same day a judge dropped the felony charge.

Ghysels was in jail for a week, accused of using force or the threat of force in an alleged sexual assault on a 16-year-old Miamisburg girl. He faced three to 10 years in prison and a $20,000 fine.

The new charge alleges Ghysels and the girl engaged in oral, vaginal and anal sex on May 7 at North Park in Springboro.

The girl "suffered physical and internal injuries as a result," Detective Lisa Walsh said in a fact sheet filed in the juvenile court.

Ghysels is charged under a section of Ohio's offenses against the family, which prohibits anyone to "aid, abet, induce, cause, encourage, or contribute to a child or a ward of the juvenile court becoming an unruly child."

If convicted, he faces up to six months in jail and a $1,000 fine.

The case was triggered after the 16-year-old sought medical treatment on May 8.

A week later, Warren County Judge Joseph Kirby ordered Ghysels released after prosecutors obtained "text messages that make it clear that this was not a rape," county Prosecutor Rachel Hutzel said.

Kirby ordered Ghysels' release after prosecutors reviewed text messages and re-interviewed the alleged victim, Hutzel said.

Ghysels, a star in multiple sports at Springboro High School, attended college in Minnesota to play football.

He recently transferred to play for the University of Dayton, where he has been admitted but is not enrolled, a university official said.
